Terms and Conditions of Sale (CGV) — Buyers — Otintiko

1. Purpose and contractual documents

These Terms and Conditions of Sale (« CGV ») govern the purchase of products offered on Otintiko, a multi-vendor marketplace (« Marketplace »), operated by ALAM HUB S.R.L.Otintiko »).

The following documents form an integral part of the contract and are accessible via the website footer:

  • Privacy Policy (and Cookies)
  • Shipping and Returns Terms – Otintiko

In the event of any conflict, these CGV prevail, unless expressly stated otherwise.

2. Definitions

  • Buyer / Customer : any person placing an order on Otintiko.
  • Seller / E-Benefiko : a third-party store offering products on Otintiko.
  • Carrier : the service provider in charge of transport (e.g., Correos de Costa Rica) according to the option chosen at checkout.
  • Order : a purchase validated on Otintiko.

3. Otintiko’s role (Marketplace) and sellers’ role

Otintiko acts as an intermediation platform : it provides the Marketplace, the ordering interface, payment tools, and a harmonized logistics framework.

  • The Seller is the seller of the products: they are responsible for the products, their compliance, their descriptions, and the sales invoice.
  • Otintiko is not the manufacturer and does not become the owner of products sold by E-Benefiko.
  • The Carrier is responsible for transport and delivery under its own rules.

4. Access conditions and legal capacity

By placing an order, you declare that you have the legal capacity required. Ordering is reserved for adults or duly authorized persons.

Otintiko does not sell alcohol on the Marketplace.

5. Products, information and availability

Each E-Benefiko is responsible for the information displayed (features, origin, formats, weights, dates, traceability, etc.).

Offers are valid as long as they are visible on the website, subject to the seller’s stock and capacity.

6. Prices, currency and taxes

Unless stated otherwise, prices are shown in Costa Rican colón (CRC). Applicable taxes (where relevant) and fees are displayed before payment is confirmed.

Multi-vendor Marketplace: if your cart contains products from several E-Benefiko, certain costs (especially shipping) may be calculated per shipper and therefore added together.

7. Ordering process and evidence

The checkout process allows you to review the cart, address, shipping method, and total before payment.

The order is deemed formed upon receipt of the confirmation email (or on-screen confirmation), subject to successful collection of payment.

8. Payment (BAC Credomatic) and security

Online payment is processed via BAC Credomatic. Card data is processed by the payment provider; Otintiko does not store full card details and receives only confirmation information (status, reference, amount).

Unconfirmed payment: as long as payment is not confirmed as collected, the order may remain in a “payment pending” status and may not be transmitted to the seller for preparation.

9. Invoicing (who issues what)

  • Sales invoice : the sales invoice is issued by the Seller (seller header), for the products sold.
  • Cancellation / refund : Otintiko may issue, as applicable, a cancellation confirmation, an internal credit note, and/or execute the refund through the payment method, with no direct financial transaction between seller and buyer.

10. Delivery, pickup and timeframes

Delivery/pickup terms (carriers, constraints, zones, delivery attempts, branch pickup, click & collect, etc.) are described in the “Shipping and Returns Terms – Otintiko” document.

Timeframes shown at checkout: the preparation and delivery timeframes displayed at checkout are estimated and indicative (unless expressly stated as a “maximum timeframe”). They may vary depending on the address, availability, the seller’s capacity, and carrier constraints.

11. Buyer obligations (address, receiving, pickup)

You agree to provide a complete, accurate and unambiguous address and a required phone number when requested.

If the address is incorrect/incomplete or you are absent during delivery attempts, delays, branch pickup, or a return may occur under the carrier’s rules. Consequences and any costs follow the “Shipping & returns” framework.

12. Cancellation before preparation

An order may be cancelled only as long as it has not been marked as prepared according to the seller’s operational statuses. When cancellation is available, it is initiated from your account (orders/returns management).

13. Right of withdrawal (“retracto”), returns and refunds

13.1 Legal principle (Costa Rica)

In Costa Rica, a right of withdrawal (“retracto”) may exist in certain off-premises/distance sales for 8 business days, only when the nature of the goods allows it.

This right has exceptions, in particular where goods, by their nature, cannot be returned or may deteriorate, including food products and perishables, or goods already used/opened depending on the circumstances.

13.2 Otintiko commercial policy (coffee and food products)

As coffee and similar products may fall under categories of goods whose return may be limited by their nature, Otintiko offers a controlled commercial returns program (without automatic obligation), described in the “Shipping and Returns Terms – Otintiko” document.

In practice, accepted returns mainly concern cases such as: preparation error, non-compliant product, transport damage (subject to evidence and carrier rules), and according to the conditions/timeframes/grounds detailed in the Shipping & returns document.

13.3 Refund method

When a refund is granted, it is made by Otintiko (never directly by the seller), to the original payment method or via a store credit where applicable, in accordance with the returns process.

14. Complaints, incidents and disputes (support)

Main channel: for any complaint (order, payment, delivery, personal data), you can contact Otintiko via the /Contact us form accessible from the footer.

Product complaint: you may also open a ticket on the seller’s page/store to discuss a product-related complaint with the seller.

In the event of a shipping incident (loss, damage, delay, non-delivery), Otintiko may coordinate the opening of a case with the seller and the carrier. Evidence may be required (photos, description, packaging, label, etc.). The final decision depends on the carrier’s rules.

15. Liability

  • Seller : product compliance, quality, information, packaging, order fulfillment.
  • Carrier : transport, delivery, tracking scans, incident procedures.
  • Otintiko : providing the Marketplace, checkout information, coordination, support, and executing refunds when granted.

Otintiko shall not be liable for indirect damages (loss of business, loss of opportunity, etc.) to the extent permitted by law.

16. Force majeure

Otintiko, the seller or the carrier shall not be held liable for delays or inability to perform due to force majeure or an external event (natural disasters, strikes, blockages, administrative decisions, carrier disruptions, etc.).

17. Personal data

Personal data processing and cookie use are described in the Privacy Policy (and Cookies).

18. Intellectual property

Website content (trademarks, logos, texts, visuals) is protected. Any unauthorized reproduction is prohibited.

19. Language — Spanish version

A Spanish version may be made available. In case of any discrepancy in interpretation, the Spanish version shall prevail.

20. Governing law and jurisdiction

These CGV are governed by the laws of Costa Rica. In case of a dispute, an amicable resolution attempt will be prioritized via support. Failing amicable agreement, any dispute shall fall under the competent courts of Costa Rica, unless mandatory provisions provide otherwise.

21. Updates to the CGV

Otintiko may update these CGV. The update date is shown at the top of the page. The CGV applicable are those in force at the time of the order.

22. Severability

If any clause is declared invalid, the remaining clauses shall remain applicable.
